He was arraigned before a magistrate court sitting in Enugu on a lone count charge of stealing.

The defendant was arrested in November 2018 upon an allegation by the complainant (tricycle owner) that he was unable to make returns to the owner of the tricycle. According to the defendant, his inability to meet up with his target was because the tricycle was faulty. He had earlier on informed the owner of the faulty nature of the tricycle of which no action was taken.

At trial, the prosecution could not field any witness therefore CAPIO applied for striking out for want of diligent prosecution. The court upheld this application and the defendant was accordingly discharged.
