ACJL Success Story
A 21-year-old was arrested and subsequently prosecuted, was an apprentice who hailed from Abor Eha-Amufu in Isi-Uzo Local Government Area of Enugu State. He was charged with a two counts offence of Unlawful possession of firearm and threat to life.
On the 14th of September 2021, the defendant was arraigned before the Magistrate’s court (Isi-Uzo Magisterial District Holden at Ikem) Enugu State, for the offences of Unlawful possession of fire arm and threat to Life. The defendant pleaded not guilty to two counts charge. From the date of arraignment till the 22nd March 2022 the case recorded no progress. The prosecution failed to produce any witness nor comply with the provisions of ACJL on frontloading documents. Following this development, the court was minded to strike out the charge for want of diligent prosecution and discharge the defendant. The court did strike out the charge and discharged the defendant.
