David was a single adult before his arrest and subsequent prosecution, was a commercial driver with a well-known transport company in the South-East. David was charged on a two-count charge of conspiracy to Felony, Stealing and Stealing. David was arraigned in 2022 but has been in custody since 2021. David was arraigned before the Magistrate Court in 2022 for the above offences. The defendant pleaded not guilty to both counts but was not granted bail even though he was entitled to bail. The matter couldn’t proceed beyond arraignment as the prosecution couldn’t not prosecute the defendant. CAPIO team of Lawyers swung into action, applying the relevant provisions of the Administration of Criminal Justice Law Enugu State 2017 (ACJL) and applied for the discharged of David (the defendant). The court agreed with the CAPIO team of Lawyers and discharged the defendant for want of diligent prosecution. The defendant appreciates the legal team and management of the Carmelite Prisoners’ Interest Organization (CAPIO) for their intervention.
